Summary of the Administrative Driver's License Suspension Law, Kansas
Motor Vehicle Hearing:
Once your driver's license has been seized by a law enforcement officer or revoked by the Department of Motor Vehicles in the state of Kansas, you must request a hearing from the Dept. of Motor Vehicles within ten (10) days of the incident prompting the seizure in order to maintain and preserve your driving privilege. A hearing must then be initially scheduled within thirty (30) days.
If your Kansas driver's license was valid at the time it was removed from your possession, you are entitled to a 30-day temporary license to drive, pending the results of your hearing. If the hearing results are not in your favor, your permanent driver's license will be suspended at the expiration of the 30-day temporary license.
In order to create the best defense possible, you should request the law enforcement officer's presence at your Department of Motor Vehicles hearing. Doing so will substantially increase your chances of winning your case, as critical defense strategies can be brought forth to convince the judge to restore your privilege to drive.
